Cyprus is preparing to significantly enhance regulations surrounding dangerous buildings, aiming to boost public safety and address persistent challenges in urban and historic areas. A major innovation in the proposed legal framework is the introduction of a category for “potentially dangerous buildings.” This proactive approach enables officials to act upon early warning signs of deterioration—before these structures escalate into immediate hazards. The expanded legal definition encompasses risks not only from structural instability but also from fire hazards, corrosion, poor upkeep, subsidence, and other defects that threaten occupant and public safety.
Under the updated legislation, officials can mandate technical inspections conducted by certified engineers following initial assessments. Property owners might be instructed to carry out urgent repairs, remove dangerous elements, or install safety barriers such as fences around hazardous sites. Owners and occupiers will have a 30-day window to respond to formal notices.
In critical cases, authorities could evacuate residents from declared dangerous buildings. Refusal to comply could lead to court actions enabling forced removal and securing the premises to prevent unauthorized access. Should property owners neglect their obligations, government bodies will have authority to disconnect utilities, undertake remediation or demolition directly, and recover costs via civil proceedings, with these expenses recorded as legal charges on the property.
The draft bill proposes substantial increases in fines: initial convictions could incur penalties up to €20,000, doubling previous limits, with follow-up offenses reaching as high as €40,000. Administrative penalties would also double, and new fixed penalty options would enable on-the-spot fines for specific violations like inadequate fencing or failure to seal unsafe buildings. Prompt payment could halt subsequent criminal prosecutions.
Municipalities and community councils must report hazardous or potentially hazardous buildings immediately, facilitating faster government action. The Development Licensing Director may delegate enforcement duties to local government officers, improving efficiency and response times.
