Cyprus Introduces Major Changes to Forced Property Sales Process

The Cyprus government is gearing up to introduce significant reforms to the forced property sales framework. These new measures aim to streamline the auction process, increase transparency, and create clearer guidelines for all parties involved. The proposed overhaul, currently open for public consultation until 8 September, promises to reshape how forced sales are executed across the island.

Understanding Forced Property Sales in Cyprus

A forced property sale generally occurs when a property owner faces a court judgment requiring the sale of their property due to unpaid debts, or when lenders enforce their mortgage rights under Cyprus foreclosure laws. Other legal rulings may also trigger such sales. The existing process aims to strike a fair balance between the creditor’s interest and protecting property owners from distressed sales at undervalued prices through the use of a reserve price.

Key Reform: Introduction of Private Property Valuers

One of the standout changes is the inclusion of private valuers in setting property reserve prices. When an application is lodged and the District Land Office notifies the applicant, a private valuer will be appointed to produce a formal valuation report indicating the market value and recommending a reserve price. The intention is to reduce the workload of the Department of Lands and Surveys, speeding up auctions and enhancing accuracy.

The fees for private valuers will be regulated and overseen by the Director in collaboration with the Cyprus Scientific and Technical Chamber’s Association of Valuers, ETEK, with adjustments typically reviewed every five years.

Automatic 15% Reserve Price Reduction After Failed Auctions

To address properties that fail to sell at auction, the draft legislation proposes a straightforward 15% cut in the reserve price for subsequent auctions occurring within five years. This replaces the previous, less predictable reductions and encourages buyers by making properties more enticing after an unsuccessful sale.

Importantly, the reserve price still sets the minimum sale price, preserving the property owner’s interests against deep undervaluations.

Revaluations Required Every Five Years

Recognizing fluctuations in market conditions, the draft law mandates a new valuation after five years from the original one. The District Land Office can request an updated valuation and revised reserve price unless there has been a significant event that materially changed the property’s value earlier, such as a legal or physical alteration.

Limiting Auctions for Undivided Properties

One of the more strategic changes targets undivided properties, which often involve protracted forced sale cases. The proposal caps the number of unsuccessful auctions at two under Article 28 applications. If a property remains unsold after two auctions and five years have elapsed, the case will be set aside, with the applicant having the option to initiate a fresh application under Article 27.

This ensures that cases do not drag on indefinitely, keeping the system efficient and fair.

Impact on Ongoing Cases and Property Market

The reforms may also affect existing cases where reserve prices are set but the sale isn’t finalized. These will be transitioned to the new rules, ensuring uniform application of the updated system.
