Growing Speculation Over Investor Passports
Speculation is on the rise that debates about investor citizenship could be rekindled across Europe, as Malta’s much-anticipated “golden passport” verdict draws near. A favorable ruling by the Court of Justice of the European Union (CJEU) may open doors for EU nations—including Cyprus—to revisit or even revive their scrapped programmes.
Malta’s citizenship-by-investment arrangement is facing intense legal and public examination. The Financial Times highlights how sanctioned Russian entrepreneurs obtained Maltese passports, effectively bypassing travel bans. In total, seven individuals receiving Maltese citizenship through this initiative later appeared on EU or US sanctions lists, raising concerns about the transparency and vetting standards of such programmes.
The European Commission has referred Malta to the CJEU, asserting that monetizing citizenship compromises the integrity of EU values. The upcoming ruling, expected shortly, will likely serve as a pivotal moment that shaping similar initiatives throughout the bloc.
Cyprus terminated its own citizenship-by-investment programme in 2020, amid international criticism and evidence of systemic misuse. While cases related to these “golden passports” remain ongoing in Cypriot courts, some observers argue the island’s current “golden visa” route might be more of a rebrand than a fundamentally new structure. The Transparency International warns that a positive outcome for Malta may encourage a “race to the bottom,” prompting other countries to consider reinstating or loosening investor citizenship rules.
Many EU countries, such as Portugal and Spain, limit their initiatives to residency rather than outright citizenship, leaving Malta as the EU’s last active “golden passport” scheme. Should the CJEU rule in Malta’s favor, the ensuing conversation could influence residency and citizenship policies in various countries—even those that previously abandoned investor-focused pathways.
