The Cyprus Appeal Court has delivered a key ruling reinforcing property buyers’ rights by dismissing an appeal from a property developer challenging the transfer of a Title Deed. This unanimous decision clarifies that unresolved disputes over communal expenses cannot be used as a reason to delay or prevent the official transfer of property ownership.
The case involves a private purchaser of an apartment in a residential development in Paphos, dating back to 1984. After settling the full agreed purchase price and receiving a separate Title Deed, the buyer filed for the property’s transfer under Cyprus’ Transfer and Mortgage of Immovable Property Law.
The developer contested this transfer, stating the buyer owed over €87,000 linked to communal charges, taxes, and fees supposedly paid by the developer on her behalf. This financial disagreement triggered the legal challenge.
The Appeal Court reviewed both the sale agreement and relevant laws, concluding that there was no legal obligation for the buyer to settle disputed communal debts before the property’s ownership could be officially transferred. Highlighting procedural clarity, the court emphasized that any monetary claims from the seller must be handled through separate civil cases and cannot interfere with the property title transfer process.
This ruling is instrumental in safeguarding the rights of buyers who have satisfied their contractual terms, ensuring they can secure legal ownership without undue delays caused by unresolved financial conflicts unrelated to the sale agreement.
In addition to affirming the Lands and Surveys Department’s decision, the Appeal Court upheld a prior ruling from the Paphos District Court dated April 4, 2025, which also dismissed the developer’s claims, citing no contractual link between communal fee payments and title deed issuance.
