Cyprus Announces Key Reforms to Forced Property Sales Process

The Cyprus government is moving forward with significant changes to the framework that governs forced property sales, aiming to streamline auctions and enhance transparency for all involved parties.

Under a new proposal drafted by the Department of Lands and Surveys, several notable updates would be introduced, including the involvement of private property valuers, fixed reductions in reserve prices after unsuccessful auctions, and limits on auction attempts for untidy or undivided properties.

Understanding Forced Property Sales in Cyprus

Forced sales occur when a property owner faces a court order due to unpaid debts or mortgage foreclosure proceedings initiated by lenders under Cyprus law. These sales can also arise from other legal decisions requiring the liquidation of assets.

The current system incorporates mechanisms to protect both creditors and property owners, especially through the use of reserve prices designed to prevent sales at unduly low levels.

Introducing Private Valuers to Expedite the Process

A core component of the reforms is the delegation of valuation responsibilities to qualified private valuers. Upon notification, the applicant would appoint a valuer to assess the property’s market value and establish the reserve price in a formal report.

This shift aims to reduce the backlog at the Department of Lands and Surveys, potentially accelerating auction timelines. Valuers’ fees will be regulated and periodically reviewed by the Cyprus Scientific and Technical Chamber’s Association of Valuers (ETEK).

Automatic 15% Reduction in Reserve Price After Failed Auctions

To introduce more predictability to the auction process, the draft legislation proposes a mandatory 15% reduction in the reserve price for any property that does not sell, applicable to subsequent auctions within five years of the original auction.

This clear-cut adjustment may make auction properties more appealing to buyers while ensuring minimum sale thresholds remain in place.

Mandatory Re-Valuation Every Five Years

Recognizing market fluctuations, the proposed rules mandate a fresh valuation after five years from the previous assessment to ensure reserve prices reflect current property values. Exceptions apply if there’s been a significant change in property status or conditions.

Two-Auction Limit for Undivided Properties

The reforms tackle drawn-out cases involving undivided properties, capping failed auctions at two attempts under specific conditions. Should these attempts fail and five years elapse since valuation, the application would be suspended, requiring the applicant’s decision to either restart the process or halt efforts.

Opportunities to Submit New Applications

If the sale is unsuccessful after these efforts, applicants may pursue a new application under Article 27 of Chapter 224 if the property remains indivisible, aiming to prevent ongoing legal stagnation.

Impact on Existing Forced Sale Cases

Transitional provisions included in the draft may apply these new rules to ongoing sales where reserves have already been set but sales are incomplete, effectively integrating current and forthcoming cases under one legislative umbrella.

What These Changes Mean for Stakeholders

For creditors and lenders, the reforms promise a potentially faster route to recouping debt through accelerated auctions. Buyers could benefit from more transparent and predictable pricing structures, notably through the set 15% discount after failed attempts.

Property owners, however, should be aware this new framework puts more pressure on resolving financial obligations ahead of forced sales.

The reforms remain open for public feedback until 8 September and could be adjusted before implementation.
